Terms of use
These terms govern your use of embernoise.com, Ember Noise apps, sound downloads, and support services (together, the Services). By downloading, accessing, or using a Service, you agree to these terms. If you do not agree, stop using the Services and delete the app.

Apple App Store terms
Apps are licensed, not sold. If you obtain Ember Noise through Apple's App Store, Apple's Standard End User License Agreement governs your licence and forms part of your agreement. These terms supplement that agreement. Apple's agreement controls if the two conflict for an App Store distribution.
This agreement is between you and Ember Noise. Apple is not a party to these supplemental terms and has no duty to provide maintenance or support for the app. Ember Noise is responsible for the app, its content, support, and product claims. This includes claims that the app fails to meet an applicable legal requirement or infringes a third party's intellectual property rights.
Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple may enforce the Apple-related provisions against you.
Your licence
Subject to the applicable store agreement and these terms, Ember Noise grants you a limited, non-exclusive, non-transferable licence to use the app for personal or internal purposes on devices that you own or control. On Apple platforms, use must follow the App Store Usage Rules and may extend through Family Sharing or volume purchasing where Apple permits it. The licence covers app updates unless an update comes with a separate agreement. Open-source components remain subject to their stated licences.
Acceptable use
You may use the Services only in a lawful way. Except where applicable law or an open-source licence permits it, you may not:
- copy, sell, rent, sublicense, or redistribute the app or its proprietary content;
- reverse engineer or try to extract source code from proprietary parts of the app;
- bypass security controls or interfere with the website, email form, transfer protocol, or another person's use of a Service;
- send malicious code, automated abuse, or deceptive messages through the website or support channels; or
- remove copyright, trademark, or ownership notices.
Maintenance and support
Ember Noise is responsible for maintenance and support to the extent required by applicable law. Contact [email protected] for help with the app. Apple has no obligation to provide maintenance or support services for Ember Noise.
Payments and refunds
The store where you obtain Ember Noise displays any price and handles payment, taxes, and refunds under its own terms. If an Apple-platform copy fails to meet an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, as its terms require. To the fullest extent permitted by law, Apple has no other warranty obligation for Ember Noise.
Your sounds and presets
You are responsible for having permission to import, play, and transfer any sound or other material that you add. Your material remains yours. The app processes and stores imported sounds and presets on your device, and it transfers them only between paired devices that you choose. The privacy policy explains this local handling and what happens when you choose to contact support.
A separate licence or attribution notice supplied with a downloadable sound or pack controls your use of that material.
Privacy and data
The privacy policy explains how Ember Noise handles information. Your use of the app does not authorize data collection beyond that policy. App activity, imported sounds, presets, and settings remain on your devices. Information leaves your device when you choose an action such as joining email updates or contacting support.
Listening safely
Ember Noise is an ambient-sound tool. It is not a medical device, treatment, hearing-protection product, emergency alert, or safety system. Keep playback at a safe volume and remain aware of your surroundings. Avoid using sound to cover alarms or warnings that you need to hear. Stop timers are a listening convenience and should not be relied on as an alarm or safety control.
Ownership
Ember Noise and its licensors own the Services, including the app, website, name, artwork, documentation, built-in sounds, and other supplied content. These terms grant the limited licence described above and do not transfer ownership. Third-party names and materials remain the property of their respective owners.
If a third party claims that Ember Noise infringes an intellectual property right, Ember Noise is responsible for investigating, defending, settling, or otherwise resolving that claim as required by law. Apple has no responsibility for such a claim.
Third-party services and links
The Services may rely on or link to platform stores, email providers, security services, and outside websites. Their own terms and privacy policies govern your dealings with them. Ember Noise does not control their availability, content, or practices.
Availability and changes
We may update, suspend, or discontinue part of a Service when needed for product development, security, legal compliance, or operations. We may change features, compatibility, and platform availability through app updates. We may also restrict website or support access when we reasonably believe that someone has violated these terms or created a security risk.
Warranties
The Services are provided "as is" and "as available." To the fullest extent permitted by law, Ember Noise disclaims implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that every Service will always be available, secure, accurate, or free of errors.
Some laws give consumers rights and warranties that an agreement cannot exclude. These terms preserve every right and remedy that applicable law says cannot be waived.
Limits of liability
To the fullest extent permitted by law, Ember Noise will not be liable for indirect, incidental, special, or consequential loss arising from your use of, or inability to use, a Service. This includes lost data, lost profits, and business interruption. These limits do not apply to liability that applicable law does not allow us to exclude or limit.
Legal compliance
You must follow the laws that apply to your download and use of Ember Noise, including applicable export and sanctions laws. You confirm that you are not located in a country subject to a relevant government embargo and are not listed on a relevant government prohibited-party list.
Ending use
You may end this agreement at any time by stopping use of the Services and deleting the app. Your licence ends if you breach these terms. Provisions about ownership, warranties, liability, and terms that by their nature continue will survive.
Changes to these terms
We may revise these terms as the Services change. The new version will appear on this page with an updated effective date. Changes apply going forward. Your continued use after the effective date means that you accept the revised terms.
General terms
These terms, the privacy policy, and any applicable store agreement form the agreement for your use of the Services. If a provision cannot be enforced, the remaining provisions continue to apply. A delay in enforcing a provision does not waive it. Mandatory consumer protections remain available to you.
